Why Korea Should Rethink Data Localization to Become an AI Powerhouse
Korea is reshaping its approach to AI regulation; however, its strategy reveals a contradiction. The government’s AI Action Plan (2026-2028)signals a genuine commitment to AI-friendly reform, but simultaneously introduces a data localization requirement that threatens to wall off Korea’s AI industry from the global cloud infrastructure and cross-border partnerships that competitive AI development demands.
The reform is driven by a limitation in Korea’s Personal Information Protection Act, which constrains AI training by requiring the pseudonymization of personal data. Pseudonymization degrades data quality, and, in turn, the effectiveness of the models trained on it. In domains like autonomous driving and personalized medicine, this loss of fidelity directly undermines accuracy with consequences for public welfare.
The government’s Action Plan marks a decisive shift. It commits to revising the Act by the fourth quarter of 2026 to permit personal data to be used for AI training without pseudonymization, subject to appropriate safeguards. This reflects a recognition that large-scale, high-quality datasets are a prerequisite for building AI systems capable of competing on the global stage, and that the regulatory framework should enable rather than obstruct that ambition. Yet a provision in the same document works against that goal.
The Action Plan stipulates that AI training using personal data may only be conducted “through private cloud infrastructure with servers located in Korea.” Data localization requirements, if applied rigidly, risk limiting Korean AI developers’ access to vast compute resources and research collaborations. For foreign cloud providers, such requirements increase the cost and complexity of operating in Korea. This can lead to them deprioritizing the Korean market, leaving Korean developers with slower, less efficient services and constrained versions of global cloud infrastructure rather than the full offering. The government plans to release detailed legal and technical guidance by late 2026, drawing on the EU’s Gaia-X initiative, a framework designed to preserve European control over data storage and access.
The Action Plan calls for the creation of a domestic environment where “AI innovation accelerates” but such development depends on modern cloud computing that is distributed across regions. Requiring domestic server location complicates Korea's AI ambitions.
Governments have a responsibility to protect sensitive personal data and critical national systems from foreign access, interference, and exploitation. However, these national security objectives do not require confining AI infrastructure to domestic soil. Strong encryption, access controls, and risk-based safeguards can achieve robust protection regardless of where infrastructure is physically located, making geographic restriction an unnecessarily blunt and ineffective instrument when more targeted tools are available.
Modern AI training is built around distributed infrastructure. Large training runs rely on globally distributed GPU clusters, cross-border data flows, and dynamically allocated compute resources—architectures built for efficiency and scale. Fragmenting training environments by geography introduces friction. It can force Korean AI developers to build and maintain costly domestic infrastructure instead of drawing on globally optimized cloud resources, limit access to cutting-edge hardware that domestic infrastructure does not replicate, and make integration into global research and model development ecosystems, where frontier development increasingly happens, significantly harder.
Domestic infrastructure mandates also have a broader economic cost. Capital diverted toward meeting regulatory requirements is capital Korean AI developers cannot invest in AI research, talent acquisition, and model development—the investments that determine long-term competitiveness.
The downstream effects of domestic server requirements extend beyond Korean developers. Small and specialist cloud providers, unable to absorb the cost of building local infrastructure will face significant barriers to participation. This will entrench the dominance of established players, reducing competition in Korea's AI market and the competitive pressure that drives innovation. The result is a market that is less dynamic, stifling the very innovation that the regulatory reform aims to promote. Korean consumers and businesses will ultimately bear this cost in the form of higher prices and slower access to AI products and capabilities that a more competitive market would deliver.
Korea aims to become a leading AI power. Achieving that will require Korean firms to compete on compute, models, and deployment at a global level, not retreat behind protectionist policies.
The path forward is clear. Regulation should be triggered by risk and use, not geography. If an AI system operates in a high-risk sector such as healthcare, finance, or critical infrastructure, it should comply with the laws governing that sector. If required, additional safeguards should be technology-neutral and implemented by the relevant sector-specific regulator. Location requirements should not substitute for outcome-based security standards.
Korea has a genuine opportunity here to design a framework that protects sensitive data while preserving the scale and interoperability modern AI systems require. The goal should not be to merely protect Korea’s firms but to produce companies capable of competing with global leaders. AI policy done right will produce Korean AI champions built to lead, not just to survive.
