The Federal Railroad Administration’s waiver process, while intended as a tool for innovation, has become a bottleneck. Inconsistent, opaque, and too often politicized, the waiver process undermines safety advancements by delaying or denying access to proven technologies like Automated Track Inspection (ATI). The result? A regulatory culture that discourages investment, hinders research and development, and puts railroads at a disadvantage compared to other modes of transportation.
